Copyright & Image Usage Information
Hey, thank you so much for commissioning, licencing, or being interested in my imagery. It means to world to me to be able to create these creative works that help your business grow and prosper. Often a great deal of work goes into producing each image, not just in the work I put in, but in the effort my clients put into to preparing the site, planning and producing the shoot, and spending time on site during the shoot, then follow-ups and revisions on the work to produce the final versions.
Then, the images go out into the world as marketing and branding tools. How those images get used by us, while also staying protected from theft and unauthorized usage, is governed by an image usage license and US Copyright Law that defends Intellectual Property.
Most of my imagery falls under the standard License Usage below. If you or any business would like to use any of my images and do not already have a license, these are the standard terms we will base that usage off of.
Unauthorized usage of these photographs is copyright infringement, and carries fines up to $150,000 per image based on US Copyright law.
Note that images must have an accompanying image credit, and that failure to accurately provide image credit constitutes copyright infringement.
Here’s a short summary of what you need to know, with links to each section:

Standard Usage License for all Clients and Licencees
This license is strictly limited to the terms and conditions below and governed by the Copyright laws of the United States, as specified in Title 17 of the United States Code:
Date: (Date of the shoot or license agreement. License goes into effect after contracts are signed, final payment has been received, and images are delivered)
Unlimited Duration - Bigger ad campaigns have the usage limited to just that campaign, etc.
Non-Exclusive - this means I and anyone else with a license can use the images. Exclusive would mean only you can use them)
Worldwide (For digital use, worldwide is pretty much always it. Print ads in different countries are where this comes into play)
Media: Company Website, Digital Social Media, Print Portfolio/Monograph, Internal Use, Email, Printed Collateral.
Editorial & Contest
Editorial Entry / Contest Entry: Covers entry only, the publication or client must license for final print / display. Client may purchase blanket editorial usage for 25% additional fee.
Advertising
Advertising use requires a per-instance license, typically 5% of ad spend.
No publication or paid advertising placements without clearance from photographer. Photographer will provide all media directly to publication
(It’s best for me to provide images directly so I can ensure they’re the right format, dimensions, DPI, color space, etc etc.)
Third Parties
All other entities wishing to use image in any way, including social media reposts, must contact the photographer to acquire their individual license.
Refer all inquiring parties directly to photographer at hi@nsdoyle.com
(More on this after the attribution section)
Hey, you commissioned an artist to make a unique work of art about something you made - don’t you just wanna shout that from the rooftops? Here’s how:
“Photography by Nicholas Doyle”, or simply “Nicholas Doyle” under an image.
One hyperlink to this site, www.nsdoyle.com, somewhere on the page - usually under the first image, at the end of an article, or among the project credits.
This is good for SEO for both of us, since it puts links to my site out in the web, and linking out from your site is smiled upon by the search deities!
Collaboration
I’ve found that collaboration is the best tool for boosting followers on Instagram, as it causes spillover from the audiences of everyone involved. I highly recommend you invite not just me as a collaborator on your posts, but everyone involved in the shoot and build / project. Here’s a recent example, where a large account featured a home I shot and invited me and my clients as collaborators, and we all saw a surge in follower growth:
Inline Image Credit
For Architecture, Design, and Real Estate Photography:
A line in the post / reel / story caption with some variation of “Photography by @Nicholasdoyle_”. This must be a clickable link to Nicholas’ Account.
This automatically tags me and I’ll repost it to my followers, as well!
For my food photography:
Do the same but with my @Epicurenicholas food photography account.
Here are some examples:
Image Sharing and Reposting
One important thing to watch out for is huge corporations stealing our work and profiting off everything we put into it while giving basically nothing in return.
They’ll ask if they can share the images and have a little “#sayyes, here are the Terms of Service” and those terms let them have the image to use for anything, anywhere, forever for free, not just for sharing one time on IG.
If anyone asks if they can use or repost the photos, simply say “Contact @Nicholasdoyle” or a friendlier “ @Nicholasdoyle can get you set up with the images!” Anything along those lines is good, and if you tag me I’ll reach out to them immediately.
I would love for these big companies to post our photos, just need them to play fair.
Image Usage and Marketing Consultation
Because my world revolves so heavily around how images are used and presented, I constantly study how the get the most out of them. I have a lot of knowledge to share about how to make an effective ad that conveys your brand intention, targets the right audience, and how to use these images to their maximum to bring in more business for you.
I’d be happy to consult on ad design, image placement, submitting photos to press, image selection for completion, and more.
I’ve considered adding this as an add-on or ongoing service to my clients, so let me know if that’s something you’d be interested in.
Questions?
I endeavor to make to make this as easy as possible and to keep you fully informed of how this process works. If you have any questions, please ask them here so I can answer them.
